What are the implications of having Spanish nationality?
Nationality means that a person belongs to a specific legal order, granting him the protection of the State and the possibility of exercising his rights in accordance with the State´s legal norms. It is more than a residence and work permit.
Spanish nationality is acquired, preserved and lost in accordance with the provisions of the law.
How can you acquire Spanish nationality?
There are different ways of acquiring Spanish nationality:
• Nationality by residence. In order to apply for Spanish citizenship by residence, it is required that you have resided in Spain for ten years. Five years is sufficient if you have a refugee status and two years if you are a national of Ibero-American countries, Andorra, the Philippines, Equatorial Guinea, Portugal or if you are Sephardic. A one-year residence is for specific cases (if you are born in Spanish territory, if you are married to a Spanish, etc.) will suffice.
• Nationality by charter is granted discretionally by Royal Decree, when the person concerned has exceptional circumstances.
• Nationality for Spanish of origin. Spaniards of origin are those born in Spain of foreign parents if at least one of them was also born in Spain or if both lacked nationality or if the legislation of neither of them attributes a nationality to the child, and those born in Spain whose filiation is unknown.
• Nationality by state possession, you can apply for it if you have owned and used Spanish nationality for ten years continuously in good faith, based on a document registered in the Civil Registry.
• Nationality by option, you can apply if you are or have been subject to the parental authority of a Spaniard, if your father or mother had been Spanish and was born in Spain, if the determination of your parentage or birth in Spain occurs after eighteen years of age and if you have been adopted by Spaniards after the age of eighteen.
What are the requirements of the documents that must accompany the application for nationality?
Foreign documents must be legalized and translated by sworn translator.
Certificates (birth, marriage, criminal records, etc.) are valid as indicated on the document itself. If the certificate does not state a term of validity it is assumed that it is 3 months.
